Utah judge weighs trial, death penalty in Charlie Kirk killing

A Utah judge is set to decide Tuesday whether Tyler Robinson should stand trial in the fatal shooting of conservative activist Charlie Kirk and whether prosecutors can continue seeking the death penalty. Robinson, 23, is accused of firing the shot that killed Kirk, 31, during a Sept. 10, 2025, event at Utah Valley University in Orem. Prosecutors argue the aggravated murder charge fits because the shooting in a crowd put other people at risk and may have been politically motivated. Defense lawyers have challenged the DNA evidence and argued the case does not qualify as a capital offense. Judge Tony Graf Jr. is expected to rule after closing arguments in Provo. Robinson has not yet entered a plea.
