PERADI proposes RUU HPI to clarify RI jurisdiction, foreign rulings
The proposal also covers international judicial cooperation, evidence exchange, and harmonization with the Civil Code and Arbitration Law.
PERADI Profesional is calling for the draft International Private Law Law (HPI), now under discussion in the House of Representatives, to be designed to better fit cross-border disputes and legal relations. At a public hearing with the special committee at the parliamentary complex in Jakarta on Monday (13/7), PERADI Profesional chairman Harris Arthur Hedar said Indonesia needs a legal system that provides certainty on court competence, choice of law, choice of forum, recognition of foreign judgments, and enforcement of international rulings. Secretary general Yuhelson added that the draft should spell out international judicial cooperation more clearly, including the exchange of information, evidence and witness testimony. They also proposed harmonizing the HPI draft with the Civil Code, the Judicial Power Law, the Arbitration Law, the Bankruptcy Law, the Notary Position Law and the Population Administration Law.
