MK orders MBG budget separated from education funds by 2028
The ruling allows the APBN 2026 scheme only, forcing the government to reorganize MBG funding sources for later years.
The Constitutional Court has ordered the budget for the Free Nutritious Meals Program, or Program Makan Bergizi Gratis, to be separated from the education budget by the APBN 2028 at the latest. Decision No. 40/PUU-XXIV/2026 was read by Chief Justice Suhartoyo in a plenary session in Jakarta on Thursday, partially granting a judicial review petition on the Explanation of Article 22 paragraph (3) of Law No. 17 of 2025 on the APBN 2026. The court said the provision remains conditionally constitutional, but only for APBN 2026. It found that education funds cannot continue to finance MBG because that could reduce compliance with the constitutional mandate for education spending. The petition was filed by Yayasan Taman Belajar Nusantara together with five individual petitioners.
