The decision let the city resume implementation after Staten Island Judge Wayne Ozzi briefly halted the surcharge on certain second homes earlier in the week. The challenge, brought by three city residents, targets the rollout rather than the legality of the tax itself. Their suit focuses on the city's publication of homeowner information and notices sent to about 17,000 people who may owe the surcharge. The tax is a signature policy of Mayor Zohran Mamdani, and the city argued a delay would disrupt a time-sensitive launch.
