Trump seeks Supreme Court rehearing on birthright citizenship
What's next: Any rehearing request must be filed within 25 days, and the court rarely grants one after a ruled case.
President Donald Trump said he will ask the US Supreme Court to rehear the case that struck down his executive order limiting birthright citizenship, extending his fight over a core immigration policy. The court ruled June 30 that children born in the United States to parents who are in the country unlawfully or temporarily are citizens at birth under the 14th Amendment. Trump signed the order on Jan. 20, 2025, targeting children of undocumented immigrants and some temporary visitors. A rehearing would be a long shot: a majority of the nine justices would have to agree, and the court has rarely granted such requests after deciding an argued case.
