NU congress urges revision of hajj law, cites 70% subsidy

The NU scholars’ forum said the current hajj benefit scheme is unfair and wants the wakalah contract with BPKH clarified.

The 2026 Munas Alim Ulama Nahdlatul Ulama in Kediri, East Java, pushed for changes to rules governing hajj funds to make them more transparent and fair. The Bahtsul Masail Qanuniyah Commission recommended amending Law No. 34 of 2014, especially Articles 10 and 16, as well as Government Regulation No. 5 of 2018 Article 21. Commission coordinator KH Abdul Ghofur Maimoen said the current distribution of the hajj fund's benefit value is not clearly defined in regulation or sharia. He said about 70 percent of the benefit value is used to subsidize pilgrims who depart, while about 30 percent goes to those on the waiting list, creating unfairness. The congress also asked for the wakalah contract form between pilgrims and BPKH to be revised so the use of the benefit value is spelled out in more detail. Another recommendation is to gradually reduce the share distributed to departing pilgrims until all pilgrims receive the benefit value fairly.
