Komisi III DPR Weighs Renaming the RUU Perampasan Aset
Proposals include “asset recovery” or “asset return” to align with UNCAC and soften the law’s punitive connotation.
Komisi III DPR is still studying the possibility of renaming the RUU Perampasan Aset after a hearing at the parliamentary complex in Jakarta. Deputy Chairman Ahmad Sahroni said the discussion is not easy and the bill’s name will be “recycled” so it does not keep coming back and forth. In an earlier forum, senior lawyer Juniver Girsang proposed changing the title to UU Pemulihan Aset Tindak Pidana or UU Pengembalian Aset Tindak Pidana. He said the terms would be more in line with the United Nations Convention Against Corruption. Yeheskiel Minggus Tiranda, a professor of law at Universitas Islam Sultan Agung, also said “perampasan” is firmer but carries a repressive connotation, while “pemulihan” is more restorative and could make international cooperation easier.
